Salman Jailed – Is Justice Being Served?(Updated)

Update 31st August’07: Salman Khan has been granted bail..finally after a week behind bars. This bodes well for the star.

For those like Maneka Gandhi, thirsting for blessed retribution, vengeful solace, this news of Salman Khan being sentenced and later jailed for poaching of a black buck , has provided good reason to avow that justice indeed does yet prevail in our land. In an interview on a news channel she made known her satisfaction at his sentencing by the High Court amply clear , if I may add with a certain sense of piquancy, while dismaying over the fact that he had been in fact let off too easily these past years. Whether her rant stemmed from being a Lover of animals or celebrity hater is confounding really.

Nevertheless, reactions to his original sentencing last year were recorded in the post reproduced below. At the time I had averred on a sentence like community service instead and ‘progressive justice’ as opposed to our outdated/outmoded laws where justice is connoted merely as requital instead of serving to indemnify.

It caused a hue and cry with certain sections of bloggers who were disquietened by the suggestion of an alternative form of justice ( read comments). Perhaps the idea was ahead of its times, I would like to think!

I felt a sense of quiet vindication when recently Kiran Bedi when asked for her reactions to the sentencing had much the same to say. .as also a wild life conservationist who is quoted as saying now “

..wildlife film-maker and conservationist Mike Pandey thought a long sentence might not really have an impact on bigger wildlife issues. “Instead of wasting five years behind bars, Salman should be given a chance to redeem himself by giving, say, 30% of his income towards animal welfare.”

Ole.. See, I have noble company. Getting him to languish in jail serves a deterrent at best, yet does nothing for the community of Bishnois . A more open minded, progressive sentence would have served justice better.

So Yes, salman has been jailed or atleast sentenced for 5 years and 25k.The 105 page order was unprecedented and passed on a Monday. Intentionally I suppose , since Tuesday is a public holiday and he cannot apply for bail or appeal in the High Court, so had to spend these couple of days in the jail with 200 undertrial dreaded terrorists from kashmir and Punjab. His mother has reportedly been hospitalised on hearing the news.

The judge validifies the harshness with ‘exemplary action’ as excuse.

Not fair. Why was ’ Exemplary action’ not served on a rape convict Sunil More? Not only was his a heinous crime but he was a cop who has taken the oath of protecting citizens. Why was he let off with just 12 years? Even lesser than a life sentence!

The girl he raped was barely 17 or so. Which means that she would be 29 when he is a free man, and probably chased by him in retribution. Apart from the fact that her life has been ruined in totality.

It is a pity that the killing of a black buck finds witnesses ready to stand by their statement come hell or high water. But the murder of Nitish Katara fails to get a conviction for the accused supposedly for lack of witness substantiation.. How much more disgusting can this get? Having envisaged an eventuality of the kind had written about this a couple of months back.

We are therfore citizens of a country where animals are more revered than humans. Enlightening!

It seems fairly clear that while on the one hand the high profile tend to take seriousness of crime with a pinch of salt, on the other hand they are also those targetted as ’sitting ducks’ often enough.

Does justice always have to mean retribution?

Will it serve in saving the black buck as an endangered species? Should not Justice mean a combination of rectifying the wrong and punishment? Solution was at hand,if only they paused to look.

Reformatory justice makes more sense . Especially in this case. The buck is a dying species..one more is dead. Salman is guilty. Would not it make more sense to punish Salman in a way that it simultaneouly furthers the cause of perpetuating the species, instead of sentencing him and the problem of the buck remains where it is. Except for the fact that at most it will be a deterrent for future killings.

Salmans good offices and finances could have been utilised for projects and schemes to create an environment to breed more of these. Now that would have been progressive and reformatory.

The Bishnois, a people who worship the black buck, need to be applauded for their unwavering stand, also need to be chided for their near sightedness in the issue.

Though they must be gloating over the judgement and feeling vindicated, It would have made more sense had they utilised this opportunity to perpetuate the species so revered..Seeing Salman serve a sentence is not going to get a buck back but had they asked the judiciary to intervene to formalise a project and made Salman responsible.. it would have served both The Buck and Justice….

The sentence as it stands today..Silly and immature. In the High Court, Salman will probably succeed in getting a stay and finally a reprieve in the sentence as well. So this transient victory will ventually be meaningless for the Bishnois, or so it seems.

Was this also an eye wash, in absence of which the Bishnois would have probably thirsted for revenge on the lawyer and judge involved?

Who knows?

    Welcome back. I have been coming here most days to see if there has been a new post from you. We all know of the tragedy you have faced and i am sure now you have been able to draw yourself out from it. Its been almost a month since your last post. Please dont dwell on it any longer. I know its easier said than done. But honestly it is a sincere advice.
    I agree with what you have stated above. Perhaps a monetary recompense via involvement might have been more suited. The Bishnois have proven to be formidable opponents. Must hand it to them.

    About salman …i love the guy so definitely feeel shit bout vot happened to him. people get away with murder, rape, incest, and what not. this guy is basically nice and yes he made a mistake so ok punish him but this is a bit much by any standards.

Kaveetaa , i truly missed..blogs n u in spirit all these days , now you’re back with a bang.Yes you are right ,I feel the judiciary need tobe blamed for this , the delays make the judgement look harsh and silly and after sometime irrelevant.I’m sure he won’t be spending 5 years in jail , he will be out soon. This is one such case pending on him , there are any other cases hit n run case ..hitting girl friends etc.so someway i think he deserved it… one might escape from law of the land but not from law of karma .

    Law of karma is an inescapable truth. Those that have understood it in its entirety will ponder before being abusive, insincere in not just their actions but even their thoughts which is the seed of karma. Its not enough to abstain from wrong action, even contemplating it or ideating with it is as if already done. Our thoughts have the potency to reach across and create vibrations positive and negative. Some people mistake good karma for just outwardly positive action while their inner world is dark, scheming, insincere and full of deceit. needless to add, their collection of Karma is as incriminatory.

  6. Hey Kaveeta,
    I totally agree with you. I think Salman is being made a scapegoat in this case. These guys want to set an example and show people that Law is above individuals, but then my argument is why were the other accused who had accompanied Salman, set free. These people are literally bullying the poor guy. They think even the media will support the decision as Salman has not been in their good books.
    But then thats how our judiciary works 😦

  7. To punish the rich and the famous has become the latest trend .Is it an eyewash to prove to the innocent and the ignorant public that nobody is above the law . If Salman really deserved this punishment it could be of a smaller magnitude ,keeping in mind his background he is not a criminal , rapist murderer, hijacker ,kidnapper or a very corrupt politician terrorist , these are the people who are walking free in our country some are even worshipped and some are trying to gain entry in politics .Salman belongs to a good family and is not a law breaker the harshness of the sentence reflects the prejudiced mind of the judge it appeared he was hell bent on punishing salmon come what may and could have even sent him to the gallows .Our judiciary has got to learn more. There are various ways of punishment, refresh your memory see do aankhen bara haath and learn from it .I conclude thinking was this sentence awarded only to save themselves(judge,lawyers) from bishnois? if yes then shame to one and all in this game, Let me be it is a very heavy price topay for being a celibrity and stardom.Both Sanjay and Salman are paying

Perhps it is a tale of personal revenge and not just the killing of a buck.. maybe he has been snared into it.. who knows.. deep dark secrets sometimes hold unholy truths.

    Right.. ‘do aankhen barrah haath is a good example. Also if you remember Dushman with rajesh Khanna and meena kumari dealt with a judge who sentenced the murderer to look after the needs upkeep and maintenance of the family whose sole bread winner he had accidentally caused the death of. Cool. How does it benefit a poor wife if the murderer is put behind bars for the rest of his life if she has to now struggle for a morsel! Justice innately means also solace to the victim I think.
